Terms of Service

Last updated February 2025

Acceptance of these terms

By creating an account or using BizESign (the "Service"), you agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use.

You must provide accurate information and be at least the age of majority in your jurisdiction to use the Service.

Access and payment

BizESign is offered as one-time purchases rather than a recurring subscription. Each plan grants a fixed number of documents you may send for signature: Bronze includes 1 document to be sent within 30 days of purchase; Silver includes 10 documents that do not expire; Gold includes 50 documents that do not expire; and Platinum includes 500 documents to be sent within three years, whichever comes first. Receiving and signing documents that others send you is always free and does not count against your document allowance.

A document is counted against your allowance when you send it for signature. Purchases stack, so allowances from multiple purchases are added together. Purchases are billed through our payment processor. Because access begins immediately, payments are generally non-refundable except where required by law.

Document storage and retention

Completed documents and their audit records are retained for seven years on every plan, after which they may be removed from the Service. You are responsible for downloading and keeping your own copies of completed documents and certificates of completion, which are available to download at any time while stored. We recommend saving a local copy once a document is complete.

Acceptable use

You agree not to use the Service to upload unlawful content, to forge or misrepresent signatures, to send documents you are not authorized to send, or to infringe the rights of others. We may suspend accounts that violate these terms.

Electronic signatures

BizESign provides tools to capture electronic signatures and related records. You are responsible for ensuring that electronic signatures are appropriate and enforceable for your particular documents and jurisdiction. See our E-Sign Consent for how electronic records and signatures work.

Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. BizESign provides an e-signature tool and does not provide legal advice. To the maximum extent permitted by law, BizESign is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for access in the twelve months preceding the claim.

Changes to these terms

We may update these terms from time to time. Material changes will be reflected by the "last updated" date above, and your continued use of the Service constitutes acceptance of the revised terms.
